Welcome to this website (the “Site”) of CTS Powersports (“Dealer,” “we,” “us,” “our”). The Site is powered by a website platform provided by Power Go Inc. (“Power Go”), a company incorporated in Québec, Canada.

These Terms of Use (“Terms”) govern your access to and use of the Site, including any content, features, tools, forms, messaging, online inventory, and any e-commerce or reservation functionality made available on or through the Site (collectively, the “Services”).

By accessing or using the Site, you agree to these Terms. If you do not agree, do not use the Site.

1. Who we are and who is responsible for the content

Dealer is the publisher of this Site and is responsible for the information presented to the public, including listings, pricing, availability, promotions, descriptions, and dealership policies.

Power Go provides the website technology and related services to Dealer, but Power Go does not own the Dealer’s inventory data or OEM data displayed on the Site and does not act as the seller of vehicles, parts, accessories, apparel, or services unless explicitly stated on the Site.

2. Changes to these Terms

We may update these Terms at any time by posting a revised version on the Site. Changes are effective when posted. Your continued use of the Site after changes are posted means you accept the updated Terms.

3. Informational purposes and accuracy

The Site may include inventory listings, pricing, specifications, images, incentives, promotions, and other information provided by Dealer, OEMs, or third parties.

Information is provided “as is” for general informational purposes and may contain errors, omissions, or be out of date.

You are responsible for verifying all information directly with Dealer before making a purchase decision, booking an appointment, or relying on the information.

Pricing and availability: Prices, fees, taxes, freight, setup, documentation fees, surcharges, and availability are subject to change without notice. Images may be stock photos and may not reflect the exact unit.

4. Transactions, reservations, deposits, and refunds (if applicable)

If the Site allows you to request a quote, reserve an item, place an order, pay a deposit, or purchase parts, apparel, accessories, or services:

· A confirmation email or on-screen confirmation does not mean your order is accepted. Dealer may accept, reject, limit quantities, or cancel orders, including for pricing errors, suspected fraud, inventory discrepancies, or other reasons permitted by law.

· Taxes, shipping, handling, and other charges may apply and will be shown before completion when possible.

· Refunds, returns, cancellations, and warranty questions are governed by Dealer’s policies, which may be posted on the Site or provided at checkout.

5. Permitted use and site rules

You may use the Site for personal, non-commercial purposes and legitimate inquiries with Dealer.

You agree not to:

· access, scrape, crawl, spider, data-mine, harvest, or index the Site or its content using automated tools without prior written permission

· interfere with the security, operation, or performance of the Site

· attempt to gain unauthorized access to accounts, forms, or systems

· use the Site for unlawful, abusive, defamatory, infringing, or fraudulent purposes

· upload or transmit malicious code, or attempt to bypass rate limits or access controls

We may suspend or block access at any time to protect the Site, Dealer, customers, or systems.

6. Intellectual property and ownership of content

Dealer content and OEM content: Unless stated otherwise, inventory listings, vehicle data, photos, videos, trademarks, and descriptions displayed on the Site are owned by Dealer, the OEM, or their licensors.

Power Go platform: The Site’s underlying software, templates, components, and platform technology are owned by Power Go or its licensors and are protected by intellectual property laws.

Limited license: You may view and print individual pages for personal, non-commercial use. You may not reproduce, republish, distribute, create derivative works from, or commercially exploit Site content without the owner’s prior written permission.

7. Trademarks

Dealer, OEM, and third-party trademarks, logos, and brand names belong to their respective owners. No rights are granted to you to use them without prior written permission.

8. User submissions (forms, reviews, messages)

If you submit information through the Site (lead forms, chat, reviews, contact forms, service requests, etc.), you represent that the information is accurate to the best of your knowledge and that you have the right to provide it.

You grant Dealer (and service providers acting on Dealer’s behalf) permission to use your submission to respond to you and to provide Services.

9. Communications consent (calls, texts, email)

By providing your phone number or email through the Site, you agree that Dealer may contact you regarding your inquiry, appointments, products, services, promotions, financing inquiries, and related customer service, subject to applicable law.

· Message and data rates may apply.

· You may opt out of marketing texts by replying STOP (or as otherwise described in the message).

· Consent is not a condition of purchase where prohibited by law.

10. Third-party links and services

The Site may link to external sites or use third-party services (maps, chat, financing tools, analytics, OEM feeds, etc.). We do not control third-party sites and are not responsible for their content, policies, or practices. Your use of third-party services may be governed by their terms.

11. Privacy

Your use of the Site is also governed by our Privacy Policy.

12. Children’s privacy

The Site is intended for a general audience and is not directed to children under 13. Do not submit personal information if you are under 13.

13. Disclaimer of warranties

To the fullest extent permitted by law, the Site and Services are provided “as is” and “as available.” Dealer and Power Go disclaim all warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

14. Limitation of liability

To the fullest extent permitted by law, neither Dealer nor Power Go will be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, or any loss of profits, revenue, data, goodwill, or business interruption arising out of or relating to your use of (or inability to use) the Site or Services, even if advised of the possibility.

Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

15. Indemnification

You agree to defend, indemnify, and hold harmless Dealer, Power Go, and their respective officers, directors, employees, contractors, agents, and affiliates from and against claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising from your violation of these Terms, misuse of the Site, or infringement of any rights of another.

16. Copyright and infringement notice (DMCA)

If you believe content on the Site infringes your copyright, send a notice including:

· your signature (physical or electronic)

· identification of the copyrighted work

· identification of the allegedly infringing material and its location (URL)

· your contact information

· a good-faith statement that the use is not authorized

· a statement under penalty of perjury that the notice is accurate and you are authorized to act

17. Governing law and venue

These Terms and any dispute arising from them will be governed by the laws of the U.S. state where Dealer’s principal place of business is located, without regard to conflict-of-laws rules.

Unless prohibited by applicable consumer protection law, any action relating to the Site or these Terms must be brought in the state or federal courts located in that state and county, and you consent to that jurisdiction and venue.

If you are a consumer, you may also have the right to bring claims in your home state or in small claims court where permitted by law.

18. Severability, waiver, entire agreement

If any provision of these Terms is found unenforceable, the remaining provisions remain in effect. Failure to enforce any provision is not a waiver. These Terms (and the Privacy Policy) form the entire agreement regarding your use of the Site.
